1. Introduction

These Terms & Conditions ("Terms") govern the services provided by BeVisible Online Solutions Ltd ("BeVisible," "we," "us," "our"). By engaging our services, you ("Client," "you") agree to these Terms.

2. Scope of Services

BeVisible provides done-for-you automation, CRM, website, funnel, and AI communication systems designed to streamline operations, enhance customer communication, and improve conversion efficiency.

Services may include:

  • CRM configuration and management
  • Website setup (where included)
  • Funnel development
  • Booking systems and calendar automation
  • Email nurturing and notification systems
  • Internal workflow automation
  • Conversational AI chat assistants
  • Voice AI agents and automated call handling
  • Knowledge base configuration
  • Ongoing optimisation and consulting

Implementation is delivered over an estimated three (3) month build and optimisation period, during which systems are configured, tested, and refined.

The Client agrees to provide timely access to required information, content, branding materials, and platform permissions. Delays in providing access or approvals may impact timelines.

3. Implementation & Optimisation

The build phase includes system configuration, workflow automation, AI setup, and optimisation. Reasonable revisions are included during the implementation period. Requests outside the agreed scope — including new integrations, additional funnels, redesigns, or system expansion — may require a separate agreement and additional fees.

4. Support & Ongoing Maintenance

Monthly maintenance may include:

  • System monitoring
  • Automation checks
  • AI response tuning
  • Workflow optimisation
  • Minor updates
  • Strategic optimisation support

AI systems may be periodically updated to reflect improvements in technology or platform capabilities.

If maintenance services are discontinued, BeVisible is not obligated to provide future updates, hosting, or optimisation.

Reactivation after suspension may require a reactivation fee.

5. Fees, Payment & Service Continuity

Clients agree to:

  • Pay a one-time build fee for system design, configuration, and deployment.
  • Pay an ongoing monthly maintenance fee for hosting, monitoring, optimisation, and continued functionality.

Monthly maintenance supports:

  • Automation reliability
  • AI functionality
  • System performance
  • Continued access to hosted infrastructure

Certain features — including AI functionality and hosting — remain active only while a maintenance plan is in place.

Failure to maintain payments may result in suspension of hosted systems, automations, and AI services after a minimum of seven (7) days written notice.

All billing terms are specified in the Client's invoice or agreement. Build fees are non-refundable once implementation work has commenced.

Hosting & Third-Party Platforms

Systems may rely on third-party platforms including CRM providers, telephony services, AI providers, hosting services, and payment processors.

The Client is responsible for:

  • Third-party usage costs (AI processing, call minutes, SMS, email sending, API usage)
  • Maintaining active third-party subscriptions where required

BeVisible is not responsible for outages, service interruptions, or platform changes caused by third-party providers.

Voice AI services depend on telecommunication networks and AI processing systems. Associated usage costs remain the Client's responsibility.

6. Intellectual Property

Upon full payment of the build fee, the Client receives the right to use the configured systems within their own business operations.

BeVisible retains ownership of:

  • Automation logic and workflows
  • System architecture
  • Templates and frameworks
  • AI prompt structures
  • Implementation methodologies

Clients may not resell, sublicense, reverse engineer, replicate, or distribute system architecture without prior written consent.

7. Confidentiality & Data Responsibility

BeVisible will treat Client data and credentials as confidential and use them solely for service delivery.

The Client:

  • Confirms they have legal rights to all data and content provided
  • Remains responsible for compliance with applicable privacy and data protection laws
  • Is responsible for obtaining required customer consents

8. AI & Voice Communication Compliance

Where AI chat or Voice AI systems are deployed:

  • Users should be informed they are interacting with an AI system where required by law.
  • Clients are responsible for complying with call recording, telecommunications, and AI disclosure regulations.
  • AI systems are designed for reliability but are not guaranteed to be error-free.

BeVisible is not liable for:

  • Missed bookings
  • Misunderstood requests
  • Communication errors
  • Telecommunication failures
  • AI interpretation limitations

9. Performance Disclaimer

Automation and AI systems are designed to improve efficiency and operational performance. However: Specific financial results are not guaranteed. Conversion increases are not guaranteed. Outcomes depend on implementation, usage, data quality, and external factors.

10. Termination

Either party may terminate services with thirty (30) days written notice unless otherwise agreed.

If maintenance services are cancelled or unpaid:

  • Hosted systems may be suspended
  • AI services may be disabled
  • Access to infrastructure may be removed

BeVisible reserves the right to refuse or terminate services for businesses operating unlawfully or in violation of compliance standards.

11. Limitation of Liability

To the maximum extent permitted by law, BeVisible shall not be liable for indirect, incidental, consequential, or special damages, including lost profits or business interruption. Total liability shall not exceed the total fees paid by the Client in the preceding twelve (12) months.

12. Governing Law

These Terms are governed by the laws applicable to the registered jurisdiction of BeVisible Online Solutions Ltd.

13. Changes to These Terms

We reserve the right to update these Terms as our services evolve or legal requirements change. The latest version will always be available on our website.
